Divorce and Finance Fixed Fees

Malcolm C Foy & Co are able to offer fixed fee legal services for Family Law. We recognise that any legal issues involving a relationship can be stressful and the cost of the process can be an additional worry. For ease, simplicity and certainty that gives our clients ultimate control over costs, we provide a professional, efficient and cost-effective Fixed Fee service, enabling clients to resolve issues and keep the emotional and financial strain that both parties face during any legal proceedings to an absolute minimum.

Depending on individual circumstances, clients can create a package geared around their own specific needs, whether it is to resolve a financial settlement, or child contact we have the specialist team to help.

What is a fixed fee?A fixed fee is simply that - a fee that is fixed. It is an agreed amount paid for a piece of work. We agree what work is needed, the cost to do it and how those costs will be paid, this approach provides clarity on the work we will complete and the ultimate cost to our clients.

We have the experience to appreciate that not every case is suitable for a fixed fee, but our experienced team will try and find a solution that is best suited to our clients’ needs, in times that are financially difficult.
How do fixed fees work?We consider each case individually and agree a plan of action with our clients. We offer fixed fees which cover the whole of an agreed plan of action or fixed fees for stages within the process. We offer fixed fee packages for court proceedings and different stages within the case. Our fixed fees enable our clients to limit representation and their costs just to the stage that is purchased. It is then personal choice as to whether or not the next stage is purchased giving ultimate control over costs.

There are situations which may arise which are unforeseen and which involve additional work. On these occasions our clients are told immediately and no further expense is incurred until a further fee arrangement has been agreed. Variations from the agreed fixed fee will occur if the work needed has changed significantly. If this occurs our Solicitors consider the change and the impact on the case, and if developments fall outside the agreed plan of action then our clients are immediately notified in writing and retain the choice of accepting a new arrangement.

Initial half hour consultation - £75.00 + VAT - Total £90.00  What is included in the initial consultation fee?

A half hour face-to-face meeting in the office with a qualified solicitor. An assessment of the clients’ individual circumstances and advice as to the most appropriate course of action. Clear and transparent estimate of fees for future work identified and whether a fixed fee service would be an option.

Payment:

£90 payable at or before the meeting. We can accept payment in cash, cheque or debit/credit card.

What clients need to do:

Provide 2 forms of identification at the meeting.

Prepare for the meeting. We will ask clients key information such as the date of marriage, children’s dates of birth. We may also ask what the estimated current value of your home is and how much is outstanding on the mortgage or other debt such as personal loans or finance. Salary details of client and spouse. Whether there are any savings policies or pension policies and how much are they worth. The more information collated at the initial meeting will enable us to be able to provide detailed advice.

In the event of further instructions being given on the day and payment taken on account of those instructions, the fee for the initial half hour consultation will be waived.

Divorce Proceedings/Dissolution (as Respondent - uncontested) - £350.00 + VAT - Total £420.00 (an additional fee of £75.00 + VAT is payable for any negotiations in relation to costs) What is included in the Divorce/Dissolution fee?

A half hour face-to-face meeting in the office, advising you and completing the acknowledgement of service slip and returning it to the court, all correspondence with you, the other side and the Court, notifying you of each stage in the proceedings up to the obtaining of the final divorce Decree Absolute/Final Order which brings the marriage/civil partnership to an end.

What is not included?

Unforeseen circumstances and complexities, for example if the divorce becomes defended, or papers require amending, or a spouse fails to progress or cooperate with the divorce. Dealing with complicating factors such as disputes over costs and attendance at a costs hearing with you or applying for the Decree Absolute on your behalf if your spouse fails to apply for it. Advice on domestic violence, financial provision or advice regarding children. The fee for the half hour initial consultation meeting.

In the event of further instructions being given on the day and payment taken on account of those instructions, the fee for the initial half hour consultation will be waived.

Payment:

£420.00 in advance if you have received the divorce papers. Alternatively, if you have not received the divorce papers you can pay in 2 instalments, with a first payment of £210 at the start of the case and a second payment of £210 when the divorce papers are received. We can accept payment in cash, cheque or debit/credit card. Please note a 1.5% surcharge is levied on all credit card payments. 

Should there be any delay by either you or your ex-spouse, unforeseen events or contested issues, this will involve extra work. In this case we will give you an estimate of what any extra costs are likely to be.

Divorce/Dissolution Proceedings (as Petitioner - uncontested) - £600 + VAT + Court Fees (£550.00) - Total £1270.00(an additional fee of £75.00 + VAT is payable for any negotiations in relation to costs)What is included in the Divorce/Dissolution fee?

A half hour face-to-face meeting advising you in the office, preparing the divorce papers, an initial letter to your spouse or their solicitor, checking the acknowledgment of service form filed by your spouse, preparing the subsequent application forms, obtaining Decree Absolute/Final Order which brings the marriage/civil partnership to an end.

What is not included?

Unforeseen circumstances and complexities, for example if the divorce becomes defended, or papers require amending, or a spouse fails to progress or cooperate with the divorce. Dealing with complicating factors such as difficulties in serving your spouse with the divorce papers or if your spouse lives abroad. Advice on domestic violence, financial provision or advice regarding children. Costs such as obtaining replacement marriage certificates, disputes in relation to costs claims, completion of Fee Remission Form, service fees for an Enquiry Agent or Swearing of Affidavit in Support. The fee for the half hour initial consultation meeting.

In the event of further instructions being given on the day and payment taken on account of those instructions, the fee for the initial half hour consultation will be waived.

Payment:

£1270.00 in advance. We can accept payment of the petitioner fixed fees by two instalments by taking an initial payment of £400 at the start of the case and a second payment of £870, which includes the court fee, when the divorce petition is ready to send to court. We can accept payment in cash, cheque or debit/credit card. Please note a 1.5% surcharge is levied on all credit card payments.

Dealing with personal service of the divorce papers if the Respondent fails to cooperate - £95 plus VAT and the process servers fee (usually £95 plus VAT)What is included?

Obtaining duplicate copies of the divorce papers from court for the process server to serve, obtaining a photograph or detailed description of the Respondent from you, instructing the process server or the court bailiff to serve the papers on the Respondent, liaising with the process server or court bailiff and notifying you of the outcome.

If personal service of the divorce papers is successful, your matter will revert back to the standard divorce fixed fee and we will advise you how to apply for the next stage of the divorce.

What is not included?Any unforeseen circumstances and complexities are not covered by the fixed fee. For example, if the Respondent evades service or if the Respondent cannot be located, resulting in personal service being unsuccessful. In such circumstances we will advise you of the alternative options available to proceed with your divorce, which will be charged on an hourly rate basis and agreed with you beforehand. In addition, the fixed fee does not cover the fee charged by the process server. This fee is separate and agreed with the process server beforehand.

Payment:

£114 in advance plus the price quoted by the process server. We can accept payment in cash, cheque or debit/credit card. Please note a 1.5% surcharge is levied on all credit card payments.

Financial Settlements - Clean Break Consent Order (no assets) - £400.00 + VAT + Court fees (£50.00) -Total £530.00What is included in the Financial settlement clean break consent order fee?

A half hour face-to-face meeting advising you in the office, initial letter of advice to you including a disclaimer as there would be no disclosure taking place, letter to your spouse and their Solicitor, drafting of consent order, documents filed at court, obtaining final order and closing letter.

What is not included?

Unforeseen circumstances and complexities, for example the obtaining and analysis of financial disclosure. Representation at court if necessary. Advice on divorce/dissolution of civil partnership, domestic violence or advice regarding children. The fee for the half hour initial consultation meeting. In the event of further instructions being given on the day and payment taken on account of those instructions, the fee for the initial half hour consultation will be waived.

Payment:

£530.00 in advance. We can accept payment in cash, cheque or debit/credit card. Please note a 1.5% surcharge is levied on all credit card payments. We may also be able to offer a flexible staged payment plan to spread the cost.

Financial Settlements - Clean Break Consent order (agreed division of assets) - £500.00 + VAT + Court fees (£50.00) - Total £650.00(an additional fee of £100 + VAT is payable if the agreement includes a pension sharing orderWhatis included in the Financial settlement clean break consent order fee?

A half hour face-to-face meeting advising you in the office, initial letter of advice to you including a disclaimer as there would be no formal disclosure of assets taking place, letter to your spouse and their Solicitor, drafting of consent order and financial statement of information, approval of pension sharing document if appropriate, documents filed at court, service of the order on any pension provider and obtaining final order and closing letter.

What is not included?

Unforeseen circumstances and complexities, for example the obtaining and analysis of financial disclosure. Representation at court if necessary. Advice on divorce/dissolution of civil partnership, domestic violence or advice regarding children. Any fees charged by the pension provide to implement the order. The fee for the half hour initial consultation meeting.

In the event of further instructions being given on the day and payment taken on account of those instructions, the fee for the initial half hour consultation will be waived.

Payment:

£650.00 in advance. We can accept payment in cash, cheque or debit/credit card. Please note a 1.5% surcharge is levied on all credit card payments. We may also be able to offer a flexible staged payment plan to spread the cost.

Change of Name Deed (Adult) - £100.00 +VAT - Total £120.00What is included in the Change of Name Deed fee?

Preparation of Change of Name Deed following satisfactory I.D checks, original Deed plus 10 certified copies.

What is not included?

Advice on divorce/dissolution of civil partnership, domestic violence, advice regarding financial provision or any linked children matters.

Payment:

£120.00 in advance. We can accept payment in cash, cheque or debit/credit card. Please note a 1.5% surcharge is levied on all credit card payments. We may also be able to offer a flexible staged payment plan to spread the cost.
